Refused PIP twice was created by 741tan

Hi everyone, i would like some advice on what to do after my 2 failed PIP claims. First claim i had 0 points for both, and then the same with the second which i then applied for a MR then appeal which I'm still waiting on. As my circ*mstances and condition has deteriorated to the point of being off work sick i put in another claim for PIP whilst my other one was going to tribunal? Can you do this or will i start afresh with the new one?

Anyway i applied again and had the PIP2 forms through again, I've just bought the membership on here so am hoping that will help. I just can't believe I've been given 0 points for everything twice... I suffer from depression, anxiety and OCD to the point of not being able to go out the house because of me worrying or checking, i cant articulate how bad things are for me in a face to face assessment, what i put down on the paper is the truth! I have doctors letters, CBT therapist letters and GP letters all supporting me which looks like has had no bearing on the outcome.

I don't know what to do anymore, it's just fighting all the time for something that you are entitled to. I can't cope with all of the information I have got take in to complete the forms, a charity did it for me last time and they did a good job but still zero points. Can anyone help and tell me what i need to do to improve my chances as i feel as though I've exhausted everything else, where do i start? Thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

You can certainly make a new claim while waiting for your Tribunal but be aware that the new claim will create a new Decision as well which will supersede any Decision made at your appeal. So the worst case scenario is that your are awarded PIP at the hearing and the new claim is again rejected, it will be this latter Decision that is carried forward.

I would start by having a read of PIP Claim guide, it explains the criteria against which you are being assessed and will be helpful to both your appeal and new claim.

If you have further questions then please reply to this post and we will do our best to help.

Thanks Gordon. How long does it normally take to get a tribunal hearing? It's been over 2 months since I sent off for a face to face heating and heard nothing since...

The average is probably 3-4 months, you should be able to get a better idea by contacting the venue.

Now i have another claim open do i have to go through with completing it? One of the reasons i opened up a new claim was because it had been so long since i heard anything from them... If i go to the tribunal and win, can't I just ignore the new claim now the PIP2 form has come? Or will i have to go through the process again and hope i get awarded?

If you don't want to continue with the new claim then you can close it by contacting the DWP, if you ignore it then a new Decision will still be made. I would phone and then follow up with a letter confirming it.

FAQs

What do I do if PIP is refused twice? ›

Before you can appeal to a tribunal, you'll need to ask the Department of Work and Pensions (DWP) to look at the decision again. This is called mandatory reconsideration. If the DWP didn't change their decision when you asked them to look at it again, you can appeal to an independent panel, called a tribunal.

Can you claim PIP twice? ›

If your illness, condition or disability has got worse since the date of your application and you were refused benefit altogether, you could make a new claim. If you were given some benefit but not as much as you think you should get now, you need to ask for your benefit to be reassessed.

Will my PIP stop if I return to work? ›

Permitted work

There is no similar provision with personal independence payment, so that the money you earn and the number of hours you work do not directly affect the PIP payable.

What is the success rate of mandatory reconsideration for PIP? ›

In fact, the Mandatory Reconsideration success rate is under 20 per cent. But don't let that put you off – if you feel you are entitled to challenge a decision or if you're not sure, speak to a financial adviser to learn more about financial planning and how to cope with money worries.

How many times can you reapply for PIP? ›

There is no restriction on you making a new claim for PIP.

What are the odds of PIP appeal? ›

The DWP said: "70 percent of the DWP decisions cleared at a tribunal hearing were 'overturned' (which is where the decision is revised in favour of the customer). Eight percent of initial decisions following a PIP assessment have been appealed and 3 percent have been overturned at a tribunal hearing."

How do you respond to an unfair PIP? ›

If it is clear that the PIP is unwarranted, you may be able to escalate your claim to HR or upper management. Be aware, this may not be a fight worth the trouble. Appealing the decision to place you on a PIP creates more friction and very rarely ends up in the decision being reversed.

What illness automatically qualifies for PIP? ›

There's actually no specific PIP list of medical conditions in the UK. You can get PIP with any disability or condition, as long as you struggle with either daily living or mobility for three months.

What happens if you fail PIP? ›

If you fail to improve after the first or final warning, this could ultimately lead to your dismissal based on your capability although you would usually be expected to have one final extension of time under a PIP (or new PIP) in which to improve.

Can PIP lead to termination? ›

Yes, an employer can terminate an employee during a PIP if they continue to perform poorly despite the warning.

What happens if you decline a PIP? ›

Signing the PIP notice

Declining to sign may be interpreted as refusing to cooperate on performance improvement, and therefore, grounds for termination.

Is PIP affected if you work? ›

Work doesn't affect personal independence payment (PIP) in so far as PIP is not means-tested and you can be paid PIP whether you are working full-time, part-time or not at all. So, you could work as a merchant banker earning millions and still be eligible for PIP.

What happens if PIP is refused? ›

You can request a Mandatory Reconsideration of the decision and, if this is unsuccessful you can appeal. Your Mandatory Reconsideration (MR) request must arrive at DWP on a working day within one month of the date of the decision letter, otherwise you must show 'good cause' for its lateness.

How do you win a PIP reconsideration? ›

You need to give specific reasons why you disagree with the decision. Use your decision letter, statement of reasons and medical assessment report to make a note of each of the statements you disagree with and why. Give facts, examples and medical evidence (if available) to support what you're saying.

Do most PIP claims get rejected? ›

Award rates for all claims (excluding withdrawn cases) over the period February 2019 to January 2024 (last 5 years) show that: 41% receive an award for normal rules new claims. 69% receive an award for normal rules DLA reassessment claims. 99% of SREL claimants are awarded PIP.

How do I appeal a PIP refusal? ›

You'll need to fill in the form, print it and post it to the DWP. You can't submit the form online. If you're not able to use the form, you can write a letter to the DWP explaining why you disagree with the decision. You can call the DWP to ask for a reconsideration, but it's better to have everything in writing.

How many PIP claims are refused? ›

Across all applications for Pip during the six-month period, 54% were accepted and 46% rejected. A DWP spokespersonsaid: “We are modernising our disability benefit system to better target it towards those who need it most and ensure people with health conditions and disabilities are receiving the right support.

What to do when PIP is not recognized? ›

First, make sure pip is installed on your system, as this may be the reason it is unable to be found. If you've just installed Python, you may want to rerun your Python installer and make sure you check the box “Add Python to PATH.” Next, click “Customize installation” and check the “pip” box under Optional Features.
